You are in a regulated context — here is what that means in practice

A regulated context is not a spectrum of "more careful" engineering. It is a binary legal state: either your system is subject to a binding regulatory framework — with enumerated obligations, mandatory controls, audit rights, and penalties — or it is not. The moment your AI pipeline ingests Protected Health Information (PHI), EU personal data, payment card data, or US federal agency data, you cross into binding compliance territory. Non-compliance is not a technical debt item. It is a legal liability that can terminate a product, result in consent decrees, and create personal criminal exposure for executives. This guide treats each framework as what it is: a contract between your engineering decisions and the law.

Regulation vs. Framework

GDPR and HIPAA are law — statutory obligations with criminal and civil penalties. NIST AI RMF and ISO 42001 are frameworks — voluntary guidance that courts and regulators use as evidence of due diligence. SOC 2 and FedRAMP sit between: not law, but contractually required for sales into enterprise and government markets. Know which category each of your obligations falls into.

A single PHI field in a training dataset puts your entire ML pipeline under HIPAA. A single EU resident's email in a user table creates GDPR obligations. Regulatory scope is not proportional to data volume — one record is sufficient. Scope determination must precede architecture decisions, not follow them.

Most regulations were written before generative AI existed. GDPR Art. 22 covers automated decision-making but was drafted for rule-based systems. HIPAA has no specific LLM guidance. PCI DSS v4.0 does not mention AI. This creates both risk (regulators interpret broadly) and opportunity (proactive engagement shapes guidance). Document your reasoning for every design decision.

EU General Data Protection Regulation

GDPR: every AI obligation from lawful basis to automated decision rights

The GDPR (Regulation 2016/679) applies to any processing of personal data of EU/EEA residents — regardless of where the data processor is located. "Personal data" includes any information that directly or indirectly identifies a natural person: names, IPs, device IDs, location coordinates, voice recordings, and critically for AI, inferred attributes (risk scores, sentiment labels, behavioral profiles) that are derived from personal data. The regulation is built on six lawful bases, eight data subject rights, and a set of obligations that apply whenever you train, evaluate, deploy, or monitor a model on personal data.

Lawful basis

Art. 6 — Six Lawful Bases

Every processing activity requires exactly one lawful basis: (1) Consent — freely given, specific, informed, unambiguous; (2) Contract — necessary for contract performance; (3) Legal obligation — required by EU/member state law; (4) Vital interests — life-or-death necessity; (5) Public task — official authority; (6) Legitimate interests — controller's interests not overridden by data subject rights. For AI training, "legitimate interests" is commonly used but requires a Balancing Test (LIA) documenting why your interests outweigh privacy impacts.

Heightened risk

Art. 9 — Special Category Data

A narrow set of data types requires explicit consent or other heightened lawful basis: health data, biometric data (for identification purposes), genetic data, racial/ethnic origin, political opinions, religious beliefs, trade union membership, sex life/orientation. Training an AI on medical records, voice biometrics, or health monitoring data automatically triggers Art. 9 — explicit consent or a specific statutory derogation is required.

Art. 22 — Automated Decision-Making

Data subjects have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. If your AI makes binding decisions on loan approvals, job screening, medical triage, or insurance pricing without a human in the loop, Art. 22 applies. Required controls: (a) meaningful human review on request, (b) right to contest the decision, (c) explanation of the logic involved. This is the primary GDPR provision triggered by production AI systems.

Art. 35 — Data Protection Impact Assessment

A DPIA is mandatory before processing that is "likely to result in a high risk" — which includes: large-scale processing of special category data, systematic profiling, automated decision-making with significant effects, systematic monitoring of a publicly accessible area, and novel technologies. ML models processing health data, behavioral profiles, or biometric features will almost always require a DPIA. The DPIA must document the necessity, proportionality, and risk mitigation measures.

Machine unlearning

Art. 17 — Right to Erasure (for AI)

The "right to be forgotten" creates a specific challenge for ML: once personal data is used in training, it is encoded into model weights — deleting the source record does not remove its contribution to the model. Machine Unlearning techniques (SISA training, gradient-based unlearning) address this, but remain computationally expensive. Document your approach in the DPIA and RoPA. For large models, retraining on an erasure-filtered dataset is often the only compliant path.

72-hour clock

Art. 33 — Breach Notification (72 hours)

A personal data breach must be notified to the supervisory authority within 72 hours of becoming aware. A breach includes unauthorized access to training data, accidental exposure of model outputs containing PII, or a model inversion attack that reconstructs personal data. "Becoming aware" starts your clock — implement detection logging that gives you a reliable timestamp. For high-risk breaches, notify affected data subjects "without undue delay."

Records of Processing Activities (RoPA)

Maintain a RoPA (Art. 30) documenting every processing activity: purposes, categories of data subjects and personal data, recipients, international transfers, retention periods, and security measures. For AI systems, each training run, fine-tuning job, inference endpoint, and evaluation pipeline is a separate processing activity. Update the RoPA before deploying a new model or adding a new data source.

DPIA Execution

Before processing

Scope the DPIA before data collection begins. Document: systematic description of processing, assessment of necessity and proportionality, risks to rights and freedoms of data subjects, and measures to address those risks. Consult the DPO. If residual risk remains high after mitigation, prior consultation with the supervisory authority (Art. 36) is required before proceeding.

Data Minimisation & Purpose Limitation

Architecture design

Collect only personal data that is adequate, relevant, and limited to what is necessary (Art. 5(1)(c)). Train models on the minimum feature set required — every additional personal attribute expands your GDPR surface. Implement purpose limitation: data collected for product analytics cannot be repurposed for model training without a new lawful basis. Enforce this in your feature store access controls.

Data Subject Rights Fulfillment

Build APIs or processes to fulfill the eight data subject rights: access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection (Art. 21), and automated decision-making rights (Art. 22). Response deadline is one calendar month, extendable by two months for complexity. Automate where possible — manual processes create SLA risk at scale.

Transferring personal data outside the EEA requires an approved mechanism: Adequacy Decision (UK, US under DPF, Japan, etc.), Standard Contractual Clauses (SCCs), Binding Corporate Rules (BCRs), or derogations. US Health Insurance Portability and Accountability Act

HIPAA: PHI definition, Safe Harbor, BAAs, and the Security Rule for AI

HIPAA (1996) + HITECH Act (2009) governs Protected Health Information (PHI) — any individually identifiable health information held or transmitted by a Covered Entity (CE) or Business Associate (BA). CEs include healthcare providers, health plans, and healthcare clearinghouses. BAs — which include AI vendors, cloud providers, analytics platforms, and any subcontractor handling PHI — must sign Business Associate Agreements (BAAs) and are directly liable for HIPAA violations. If your AI product processes, stores, analyzes, or trains on PHI, you are a Business Associate.

De-identification

18 PHI Identifiers (Safe Harbor)

HIPAA Safe Harbor de-identification requires removing all 18 identifiers: names, geographic subdivisions smaller than state, dates (except year) for individuals >89, phone/fax numbers, email, SSN, medical record numbers, health plan beneficiary numbers, account numbers, certificate/license numbers, VINs, device identifiers, URLs, IPs, biometric identifiers, full-face photographs, and any other unique identifier. For ML feature engineering, each of these must be explicitly stripped before data can be treated as de-identified.

Expert Determination

The second HIPAA de-identification path: a qualified statistical expert certifies that the risk of identifying any individual is "very small" and documents the methods. This allows retention of features like rare disease codes, precise dates, and geographic detail that Safe Harbor would remove — at the cost of engaging a biostatistician and maintaining their certification. Common for academic health AI research where clinical detail is essential.

Legal contract

Business Associate Agreement (BAA)

A BAA is a legally required contract (45 CFR §164.308(b)) between a CE and any BA that handles PHI. The BAA must specify: permitted uses and disclosures of PHI, safeguards required, obligation to report breaches, access rights for CEs, and disposition of PHI upon contract termination. AWS, Google Cloud, and Azure offer BAA-eligible services — but you must activate the BAA explicitly. Lacking a BAA while handling PHI is itself a HIPAA violation.

Data minimization

Minimum Necessary Standard

Covered Entities must make reasonable efforts to limit PHI to the minimum necessary to accomplish the intended purpose (45 CFR §164.514(d)). For AI training: request only the fields required for the specific model task, not full patient records. For inference: return only the minimum PHI needed in the response. Implement column-level access controls in your data warehouse and log every field-level access with purpose justification.

Security Rule: Technical Safeguards

The HIPAA Security Rule (45 CFR §164.312) mandates technical safeguards for electronic PHI (ePHI): (a) Access controls — unique user IDs, emergency access, auto-logoff, encryption/decryption; (b) Audit controls — hardware/software activity recording; (c) Integrity controls — ePHI not altered or destroyed improperly; (d) Transmission security — TLS 1.2+ for all ePHI in transit, AES-256 for ePHI at rest. Every ML pipeline component that touches ePHI must satisfy all four categories.

Breach Notification Rule

Breaches affecting >500 individuals in a state must be notified to HHS and prominent media within 60 days of discovery. Smaller breaches are reported to HHS annually. A "breach" is presumed unless you can demonstrate low probability of PHI compromise via a 4-factor risk assessment: nature of PHI involved, who accessed it, whether PHI was actually acquired, and extent of risk mitigation.   • Apply HIPAA Safe Harbor de-identification (remove all 18 identifiers) or obtain Expert Determination certification before using data for AI training.
  • Encrypt all ePHI at rest (AES-256) and in transit (TLS 1.2+) — document encryption in your Security Risk Assessment.
  • Implement unique user authentication with MFA for all systems accessing ePHI — no shared accounts.

  • Train all workforce members on HIPAA policies annually — document completion.

Payment Card Industry Data Security Standard

PCI DSS v4.0: cardholder data, CDE scoping, and the 12 requirements for AI

PCI DSS is a contractual standard administered by the PCI Security Standards Council (PCI SSC), mandated by Visa, Mastercard, Amex, and Discover in their merchant agreements. It applies to any organization that stores, processes, or transmits cardholder data (CD) — the combination of Primary Account Number (PAN), cardholder name, expiration date, and service code. The Cardholder Data Environment (CDE) is the network segment containing CD and systems that connect to it. AI systems analyzing transaction data, fraud patterns, or payment workflows are in-scope for PCI DSS the moment they touch or can reach CD.

Architecture

CDE Scoping — the most critical decision

Every system that stores, processes, or transmits cardholder data is in-scope. Every system that connects to an in-scope system is also in-scope. An ML model training on raw transaction logs with PANs is in-scope. A fraud detection model receiving tokenized transaction data (no PAN) can potentially be out-of-scope if network segmentation is correctly implemented. CDE scope drives your entire compliance surface area — minimize it first.

De-scoping

Tokenization vs. Encryption

Tokenization replaces the PAN with a format-preserving surrogate (token) with no mathematical relationship to the original. The original PAN lives only in the token vault. A model trained on tokens is out-of-CDE-scope because tokens have no payment value. Encryption preserves a reversible relationship — encrypted PANs keep the system in scope. For AI workloads: tokenize at ingestion, train on tokens, never expose PANs to the model.

Scope reduction

Network Segmentation

PCI DSS does not require network segmentation, but without it, your entire network becomes in-scope. Proper segmentation — using firewalls, VLANs, and zero-trust microsegmentation — isolates the CDE from out-of-scope systems. Your ML training cluster should sit in a separate network segment with no path to the CDE. If a data pipeline copies tokenized data to the training cluster, that specific pipeline must be in-scope but the cluster can remain out-of-scope.

Validation

SAQ vs. ROC Assessment

Merchant Level 1 (>6M Visa transactions/year) requires an annual Report on Compliance (ROC) from a Qualified Security Assessor (QSA). Levels 2–4 may use a Self-Assessment Questionnaire (SAQ) — the appropriate SAQ type depends on your payment channel. Service providers (like AI fraud detection vendors) have their own level tiers and must provide a current Attestation of Compliance (AOC) to their merchant clients.

PCI DSS 6

Req 6: Secure Software Development

PCI DSS v4.0 Req 6 explicitly covers bespoke and custom software including AI/ML models used in payment processing. Required controls: code review or automated analysis for vulnerabilities before production deployment, OWASP-aligned security testing, patch management with defined timelines (critical patches: 1 month), and a software inventory. Your ML pipeline is software — apply SAST, SCA, and adversarial robustness testing as part of the build process.

PCI DSS 10

Req 10: Logging & Monitoring

All access to system components and cardholder data must be logged and reviewed. Log retention: 12 months total, 3 months immediately available. For AI systems: log every query to a fraud model that processes in-scope data, every training job on in-scope data, and every data pipeline access to the CDE. Use a SIEM with automated log review and anomaly alerting. Log tampering must be detectable.

Req 1–2: Secure Network & Defaults

Foundation

Install and maintain network security controls (firewalls, ACLs) around the CDE. Change all vendor-supplied default credentials and remove unnecessary services. For ML infrastructure: harden container images, disable debug endpoints, change default model serving ports, and enforce network policies that allow only authorized traffic to training/serving clusters.

Req 3–4: Protect Stored & Transmitted Data

Data layer

Do not store sensitive authentication data after authorization. Render PAN unreadable anywhere it is stored (hashing, tokenization, encryption). Protect cardholder data in transit with TLS 1.2+. For AI: never log raw PANs in training data pipelines or model outputs. Hash or tokenize PANs at the earliest possible point in the ingestion pipeline.

Req 5–6: Vulnerability Management

Software security

Protect all system components against malware. Develop and maintain secure systems and software. Applies to ML code: scan model dependencies with SCA tools (pip-audit, Trivy), run SAST on training scripts, and validate model outputs for injection vulnerabilities. Req 6.3.3 requires all custom software patches deployed within defined timeframes.

Req 7–9: Access Control & Physical Security

Access control

Restrict access to cardholder data by business need-to-know (RBAC). Identify and authenticate all users; MFA required for all access into the CDE and for all remote access. For ML: implement column-level access control on feature stores containing payment data. Training job service accounts should have read-only access to exactly the tables required — no broader.

Req 10–12: Monitor, Test, Policy

Beyond GDPR, HIPAA, and PCI DSS, most AI companies operating at scale will encounter at least one additional compliance framework depending on their customer base. Enterprise SaaS requires SOC 2. Federal government requires FedRAMP. California-resident data triggers CCPA/CPRA. US federal agency internal systems require FISMA/NIST RMF. Each has distinct scope, controls, and evidence requirements.

SOC 2 — Five Trust Service Criteria

SOC 2 is an audit standard (AICPA AT-C 205) evaluating controls relevant to Security (CC series), Availability (A series), Confidentiality (C series), Processing Integrity (PI series), and Privacy (P series). Type I: point-in-time design effectiveness. Type II: 6–12 month operating effectiveness. Enterprise customers increasingly require SOC 2 Type II with AI-specific criteria: training data integrity, model change management, bias monitoring, and explainability audit trails.

US Federal

FedRAMP — Authorization to Operate

Federal Risk and Authorization Management Program — required for any cloud service used by US federal agencies. Three impact levels: Low, Moderate (most common — protects CUI), High (national security). Requires a full NIST SP 800-53 control implementation, 3PAO (Third Party Assessment Organization) assessment, and ongoing continuous monitoring (monthly vulnerability scans, annual pen test, POA&M management). FedRAMP Moderate requires ~325 security controls — plan 12–18 months for initial authorization.

California law

CCPA / CPRA — California Consumer Privacy

California Consumer Privacy Act + Proposition 24 amendments apply to businesses meeting any threshold: >$25M annual revenue, OR buy/sell/share personal data of >100K consumers/households, OR derive >50% revenue from selling/sharing personal data. Rights: know, delete, correct, opt-out of sale/sharing, limit use of sensitive personal information. AI-specific: automated decision-making subject to opt-out rights; businesses using personal data for AI training face opt-out obligation.

FISMA / NIST RMF — Federal Information Security

Federal Information Security Modernization Act requires federal agencies and their contractors to implement NIST SP 800-37 Risk Management Framework for all federal information systems. Applies to AI systems built for or deployed within federal agencies. Controls from NIST SP 800-53 Rev 5 are organized into 20 families (AC, AT, AU, CA, CM, CP, IA, IR, MA, MP, PE, PL, PM, PS, RA, SA, SC, SI, SR, PT). An ATO must be obtained from an Authorizing Official before system operation.

Global standard

ISO/IEC 27001 — Information Security ISMS

Globally recognized certifiable ISMS standard. Annex A provides 93 controls across 4 themes: Organizational (37 controls), People (8), Physical (14), Technological (34). Technological controls relevant to AI include A.8.24 (use of cryptography), A.8.25 (secure development lifecycle), A.8.28 (secure coding — covers ML pipelines), A.8.15 (logging), and A.8.16 (monitoring). ISO 27001 certification is frequently required for EU public sector and healthcare procurement.

Multi-framework

HITRUST CSF — Healthcare + Multi-Framework

Health Information Trust Alliance Common Security Framework — a certifiable framework that maps to HIPAA, NIST, ISO 27001, PCI DSS, and state regulations simultaneously. Popular with US health AI companies because a single HITRUST r2 certification satisfies multiple customer audit requests. Three levels: e1 (essential), i1 (implemented), r2 (risk-based, most rigorous). HITRUST assessments are expensive ($150K–$500K) but eliminate redundant vendor audits.

Checklist

  • Determine your SOC 2 scope: which Trust Service Criteria apply to your AI product (minimum: Security).
  • For FedRAMP: classify your system at Low/Moderate/High based on the potential impact of a confidentiality, integrity, or availability breach.
  • For CCPA/CPRA: implement a "Do Not Sell or Share My Personal Information" mechanism if personal data is used for AI training or shared with third parties.
  • Map each AI system to the applicable regulations before any architecture decisions — scope determines controls, controls determine cost.
  • If serving multiple regulated industries, evaluate HITRUST CSF as a consolidation strategy before running parallel compliance programs.
  • Establish a cross-framework control mapping (GDPR Art. 32 ≈ NIST 800-53 SC controls ≈ ISO 27001 A.8 technological controls) to avoid duplicating evidence.

Multi-framework engineering

Unified compliance architecture: one control set that satisfies every framework

Running four parallel compliance programs (HIPAA, GDPR, PCI DSS, SOC 2) independently is expensive and creates inconsistent security posture. The insight that enables scale: most frameworks require the same underlying controls, just expressed differently. A unified compliance architecture implements controls once, maps them to multiple framework requirements, and produces audit evidence automatically. This is the engineering discipline sometimes called "compliance-as-code."

Build a single control catalog that maps requirements across frameworks. Example: Encryption at rest (AES-256) satisfies HIPAA §164.312(a)(2)(iv), GDPR Art. 32(1)(a), PCI DSS Req 3.5, SOC 2 CC6.1, and FedRAMP SC-28 simultaneously.
